User Terms for Video Creators

These User Terms for Video Creators (the “Terms”) apply when you create or upload content on our platform. They are an agreement between you and SocialVenu, Inc. (“SocialV,” “we,” “us,” or “our”). By creating an account or uploading content, you agree to these Terms. If you do not agree, do not create an account or upload content.

1. Videos You Create on the Platform

How you become a user. You become a user when you create an account, or are invited to create an account, on our web application at www.socialv.io or www.socialvenu.com (the “WebApp”). The “Platform” means the WebApp and any other SocialV video tool, including versions that carry a Customer’s name or branding. You create videos on the Platform.

Your content. “User Content” means the videos, pictures, and other content you create or upload on the Platform, including any images, voices, captions, and text they contain.

Customers. Our customers are businesses and organizations that use the Platform to collect videos. For each piece of User Content, the “Customer” is the business or organization that invited you to create it, or whose page, link, or QR code you used to create it.

2. How Your Videos Are Used

Videos are used for marketing, sales, and support. The Customer and SocialV may use your videos for their own purposes, including on their websites and in their marketing and sales efforts. SocialV may also use your videos worldwide, including in SocialV website plug-ins, SocialV’s YouTube business directory, and SocialV’s social media channels. Section 7 explains who owns your User Content and what the Customer and SocialV may do with it.

3. Your Responsibilities

You are responsible for the videos you create. By posting a video, you agree that:

You are solely responsible for your account and for all activity that occurs while you are signed in.
You will not post information that is malicious, false, or inaccurate.
You will not post content that infringes a third party’s intellectual property rights.
We may decide whether any User Content is appropriate, remove any User Content, and terminate your account without prior notice.
You are solely responsible for any liability, loss, or damage resulting from the use of User Content you make available.
SocialV does not pre-screen or monitor all User Content, although we may monitor interactions at our discretion.

4. Indemnification

You agree to defend and indemnify SocialV and its agents, customers, and employees against any third-party claim arising from a video you posted that violates these Terms or infringes a third party’s intellectual property rights.

5. Privacy and Personal Data

When you sign up for or interact with the Platform, we may collect the following information about you (“Personal Data”):

Sign-up information: your name, email address, mobile number, and IP address.
User Content: videos, pictures, and other content you choose to upload.

Sharing. We share your Personal Data with hosting providers, customers, service providers, partners, and our staff.

6. Ownership of Content

When you upload a video or other User Content, you irrevocably assign all rights in it, including copyright, to the Customer and SocialV, worldwide and for the full term. Uploading is your signed assignment, enforceable by SocialV or the Customer. Each may independently use, edit, adapt, publish, and license it, with your name, likeness, and voice, for any purpose, including advertising, without further permission or payment. You waive all rights where allowed and represent that you own it and can assign it.

7. Security and Rights

Security. We use technical and organizational measures to protect data, but we cannot guarantee that it is safe from unauthorized access.

Your rights. Depending on where you live, you may have rights under applicable law to access, correct, or delete your Personal Data. We will make reasonable efforts to honor these requests promptly.
